1. Acceptance of Terms
By downloading, installing, or using the Markstone application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Markstone is a markdown viewer and editor application for iOS, iPadOS, and macOS devices. The App allows users to:
- View and render markdown files
- Organize folders as projects
- Edit markdown files (Pro feature)
- Customize the viewing experience
3. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes on devices that you own or control.
4. Subscriptions and Purchases
4.1 Free Tier
The App offers a free tier with limited features, including up to 3 projects and read-only access to markdown files.
4.2 Pro Subscription
The Pro subscription provides unlimited projects, editing capabilities, and priority support. Subscriptions are billed annually through the App Store.
4.3 Lifetime License
A one-time purchase option that provides permanent access to all Pro features and future updates.
4.4 Free Trial
New users may be eligible for a 14-day free trial of Pro features. The trial automatically converts to a paid subscription unless cancelled before the trial period ends.
4.5 Billing
All payments are processed through Apple's App Store. By making a purchase, you agree to Apple's terms of service and payment terms. We do not have access to your payment information.
4.6 Refunds
Refund requests are handled by Apple according to their App Store refund policies. We cannot process refunds directly.
5. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App to infringe on intellectual property rights of others
- Maintain the security of your device and any files accessed through the App
- Be responsible for all content you create, edit, or store using the App
6. Intellectual Property
6.1 Our Property
The App, including its design, code, features, and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
6.2 Your Content
You retain all rights to your markdown files and any content you create or edit using the App. We do not claim any ownership or rights to your content.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we handle (or rather, don't handle) your data. In summary: your files stay on your device, and we don't collect personal information.
8. Disclaimers
8.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 No Guarantee
We do not guarantee that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- Any errors in the App will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
11. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your license to use the App ends immediately
- You must delete all copies of the App
- You retain all rights to your own content and files
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the Netherlands Arbitration Institute.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
